Courts back OSHA & healthcare vax mandates
While the federal contractor vaccine mandate is on hold nationwide by order of a federal judge last month, two other vaccine mandates have been revived at least temporarily. One was partially reinstated.
On Dec. 14, a federal appeals court reinstated a federal COVID-19 vax mandate affecting healthcare workers in 26 states. The judges said a lower court overstepped by issuing a national injunction. The injunction is still in place for 14 states.
On Dec. 17, another federal appeals court upheld OSHA’s mandatory “vaccine or test” rule for private companies with more than 100 employees. The case goes before the Supreme Court this month.
A judge put President Biden’s vaccine mandate for federal contractors on hold temporarily on Dec. 7. It is pending in a federal appeals court.
Court decisions for the other mandates may influence the outcome of the federal contractor mandate, Attorney Shane McCall wrote in the SmallGovCon blog. “Some of the same analysis used in connection with whether the large business mandate is enforceable could apply to the contractor vaccine mandate,” he wrote.

“Extra year” expires for some 8(a)s on Jan. 13
The SBA announced last year that all 8(a)s would have an “extra year” in the program starting Jan. 13, 2021, due to COVID19. That year is expiring shortly for 8(a)s that had been close to graduating from the 9-year program.
