WOSB rule proposed
A new proposed rule for the Women-Owned Small Business (WOSB) contracting program at the Small Business Administration would set a new process for verifying certification of WOSBs and EDWOSBs and would allow WOSBs and EDWOSBs to bid on contracts while they have pending certification decisions.
Under the proposed rule, contracting officers will be required to check SAM.gov or DSBS (Dynamic Small Business Search) to determine if an EDWOSB or WOSB is certified or has a pending application for certification in DSBS. Previously, such checks were made in the WOSB Repository, which is now defunct.
Also, offers may be solicited from WOSBs or EDWOSBs with pending applications for certification. If an apparently successful offeror has such a pending application, the contracting officer must contact SBA. Within 15 days, SBA will determine the offeror’s status as a WOSB or EDWOSB.
The rule would revise the FAR to implement Section 825 of the national defense authorization law of fiscal 2015. Comments are due by Dec. 6.
