SBA limits 8(a) bids with JVs for STARS III
The Small Business Administration intends to prohibit awards of 8(a) STARS III contracts in situations where an 8(a) firm bids both individually as a prime contractor and also as a member of a joint venture, according to an analysis by law firm PilieroMazza PLLC.
The SBA and General Services Administration recently released additional guidance on eligibility and compliance for 8(a) STARS III after a “flood of questions” about 8(a) firms potentially submitting multiple bids on their own and as part of joint ventures, PilieroMazza attorneys wrote.
“It is now clear from GSA and SBA that 8(a) firms cannot submit a proposal both as itself (sic) and as any member of a joint venture. This is not limited to JVs where the 8(a) is the company upon whom eligibility for the JV is based. Similarly, GSA and SBA have also made clear that an 8(a) firm cannot be part of multiple JVs to bid on STARS III,” the attorneys wrote.
