New final rules in effect soon

Micro-purchase, SAT thresholds raised in FAR

      The federal acquisition councils published several final rules in recent weeks, including:

  • Micro-purchases & SAT: Effective Aug. 31, the micro-purchase threshold increases to $10,000, from $3,500; and the Simplified Acquisition Threshold rises to $250,000, from $150,000. Simplified acquisition awards under special emergency authority can go up to $500,000, from $300,000. Many agencies had already put the higher thresholds in effect but the final rule makes them official for all agencies.
  • Evaluation Factors for Multiple-Award Contracts: Effective Aug. 3, the final rule states that solicitations for multiple-award contracts to be awarded for “the same or similar services” to each qualifying offeror do not require price or cost as an evaluation factor for contract award. It applies to certain task order contracts issued by DOD, NASA and the U.S. Coast Guard.
  • Certified Cost or Pricing Data: Effective Aug. 3, the threshold for requesting certified cost or pricing data increases to $2 million, up from $750,000, for contracts entered into on July 1, 2018 or later.
  • Fax & E-Commerce Orders: Effective Aug. 3, agencies are permitted to issue a task order or delivery order via fax or e-commerce platforms. The rule clarifies when an order is “issued” under these methods.
  • DD Form 254: Effective Aug. 3, the final rule amends the FAR to provide procedures for using DD Form 254, Contract Security Specification, and for submitting the form electronically through use of the Procurement Integrated Enterprise Environment (PIEE).

          The DD Form 254 must be used by DOD components and by nondefense agencies that have industrial security services agreements with DOD. For submission contractors must use the National Industrial Security Program Contracts Classification System module of the PIEE, unless the nondefense agency has an existing DD Form 254 information system.
