House passes NDAA
Includes small business provisions
The House passed the National Defense Authorization Act for 2016, including several small business provisions.
The NDAA is likely to get a Senate vote shortly.
However, the bill’s future is uncertain because President Obama has threatened a veto over $38 billion in overseas contingency operations funding that Democrats say would be diverted to domestic military needs to skirt sequestration cuts. The Democrats said giving defense a special exemption to sequestration now would make it harder to reach a bipartisan deal to roll back sequestration caps for all agencies.
The House Small Business Committee said in a news release that the NDAA approved by the House includes these provisions:
- Section 868, which modifies the process by which the Small Business Administration develops the Small Business Procurement Scorecard;
- Section 869, which creates a statutorily independent Office of Hearings and Appeals at the SBA to hear challenges to size standards;
- Section 871, which includes subcontracting goals in agency responsibilities;
- Section 867, which allows small business teams to rely on individual team members’ past performance;
- Section 862, which ensures that agencies properly identify and justify decisions to bundle contracts; and
- Section 863, saying bundling and consolidation justifications should be published with solicitations.
