DOD enhanced debriefings
The Defense Dept. proposed a new rule for post-award debriefings that would provide several significant legal rights to small contractors.
The DOD was required to issue the rule under Section 818 of the National Defense Authorization Act for fiscal 2018 Comments are due by July 19.
The rule only applies to DOD post-award debriefings. According to an analysis by PilieroMazza PLLC, these are the other substantial features of the new rule:
- Right to a Debriefing: If requested within three days of notification of award, a debriefing would be required for all contracts, task & delivery orders of $10 million or more.
- SSDD Disclosure: For awards of $10 million-$100 million, contractors may request a redacted Source Selection Decision Document (SSDD).
- Right to Ask Follow-Up Questions: Offerors may submit questions within two business days after a debriefing, and the agency must respond within five business days after receipt.
- Timeframes for Suspension of Performance Following Protest: The rule sets several timeframes, within 5-10 days, for the Government Accountability Office to provide notice to suspend performance.
