Bona fide place-of-biz extension

      The Small Business Administration is suspending the bona fide place of business requirement for 8(a) Business Development construction contracts until September 2023, PilieroMazza PLLC reported.

      8(a) firms are required to have a bona fide place of business in the geographic region of any 8(a) construction contract.

      SBA suspended that rule in August 2021, judging that it was unfeasible during the pandemic. The suspension was to remain in place until Sept. 30, 2022.

      On June 22, John Klein, SBA’s associate general counsel, announced at an 8(a) conference that the rule continues to be unfeasible and the suspension has been extended until September 2023.

      “Presumably, this moratorium will continue to apply to contracts offered to the 8(a) program from Aug. 25, 2021 to Sept. 30, 2023,” Meghan Leemon, attorney, wrote in the PilieroMazza client alert.
