NMR waiver termination

      The Small Business Administration on June 8 terminated class waivers of the Nonmanufacturer Rule (NMR) for furniture-related industries, effective immediately.

      Under the NMR, firms receiving small business set-asides must provide products made by themselves or other small business manufacturers. The government grants class waivers of the NMR for classes of industries in which there are no small businesses. If small firms enter the industries, the class waiver is canceled.

      The NMR class waiver was terminated for manufacturing in the following NAICS and Product Service Codes (PSCs):

  • Furniture Frames and Parts, Metal--NAICS 337215 PSC 7195;
  • Furniture Frames, Wood--NAICS 337215 and PSC 7195;
  • Furniture Parts, Finished Plastics-- NAICS 337215 and PSC 7195;
  • Furniture, Factory-type (cabinets, stools, tool stands, work benches)--NAICS 337127 and PSC 7110;
  • Furniture, Hospital (hospital beds, operating room furniture)--NAICS 339113 and PSC 7195; and
  • Furniture, Laboratory-type (benches, cabinets, stools, tables)-- NAICS 337127 and PSC 7195.

      The class waiver was granted in 2006, and cancellation requested in 2019 because small businesses were operating in the named industries. In February, SBA announced pending termination.

      Now that the class waiver is gone, small businesses “will no longer be authorized to provide the product of any manufacturer regardless of size on the identified items, unless a Federal Contracting Officer obtains an individual waiver to the NMR,” SBA said in the notice.

      The NMR does not apply to small business set-asides valued between the micro-purchase threshold and the Simplified Acquisition Threshold. However, The NMR does apply to socioeconomic set-aside and sole source acquisitions over the micro-purchase threshold.
