GAO upholds new SBA rule
The Government Accountability Office upheld a protest against an Air Force RFP, on the grounds that the RFP did not comply with a new Small Business Administration regulation regarding small business protege past performance.
The GAO ruled in favor of Innovate Now LLC, who protested in January against the Air Force’s RFP. The RFP improperly required that a protege and mentor in a joint venture must have the same level of experience, GAO said.
The RFP contradicted an SBA regulation that went into effect in November 2020 ordering that proteges in a joint venture cannot be required to have the same level of past performance and experience as their mentors.
