Rescissions of Trump era DOL rules
The Labor Dept. announced two new rulemakings to rescind two regulations imposed by the Trump Administration. DOL says those regulations--which pertain to independent contractors and joint employers--significantly weaken protections under the Fair Labor Standards Act (FLSA).
DOL proposes to withdraw the “Independent Contractor Status under the FLSA” rule, published on Jan. 7, 2021 and effective in May. The rule would have narrowed the definition of contractors protected by FLSA by establishing a new and unproven “economic reality” test, DOL said in a news release.
DOL also wants to rescind the “Joint Employer Status Under the FLSA” rule that took effect in March 2020. A U.S. District Court in September judged that the regulation was contrary to the FLSA.
