Buy American final rule

      The GSA, Defense Dept. and NASA published a final rule to amend the FAR to implement Section 8 of President Biden’s Executive Order 14005 on Buy American policies.

      The final rule, effective Oct. 25, will:

• Raise the domestic content threshold to 60% immediately, up from 55%;
• Raise the threshold to 65% starting Jan. 1, 2024, and to 75% starting Jan. 1, 2029;
• Allow some products and construction material to meet the existing 55% threshold under certain circumstances; and
• Create a framework for an enhanced price preference for domestically-sourced “critical” items or components.
