FAA HUBZone set-asides
From 2011 to 2020, the Federal Aviation Administration did not award any HUBZone small business set-aside contracts, according to USASpending.gov data.
But that could be changing soon as the FAA recently added HUBZone preferences to its procurement toolbox for the first time.
The FAA has its own acquisition rules and is not governed by the Federal Acquisition Regulations (FAR). It is exempt from the Small Business Administration’s regulation requiring agencies to set goals for HUBZone procurements, among others.
However, the FAA recently added HUBZone set-aside provisions to its Acquisition Management System that closely resemble the HUBZone clauses in the FAR.
“FAA is incorporating HUBZone set-asides,” announced the FAA’s Small Business Office on Feb. 8. “The FAA has added the ability to set-aside individual procurements to small HUBZone certified businesses.”
The next step for the FAA could be establishing HUBZone goals, according to Nicole Pottroff, senior associate with Koprince Law firm.
“This could be some really big news–as FAA has not included HUBZone contracting language in the Acquisition Management System in the past,” Pottroff wrote in a recent blog.
“Though we are not sure yet what, when, or how exactly the FAA will establish its HUBZone contracting goals moving forward–based on these updated clauses–we are optimistic that HUBZone goals are coming,” she added.
FAA officials were not immediately available.
