GSAR gets 48 changes
Should the General Services Administration have made more effort to consult with small vendors about dozens of recent changes to the GSA Acquisition Rule (GSAR)?
The Coalition for Government Procurement is urging the GSA to redo the rulemaking for that purpose.
The GSA added 35 clauses to the GSAR that previously had been implemented through internal Federal Acquisition Service guidance.
The agency also is modifying 13 other clauses in the GSAR.
None of the changes will have much impact, the GSA asserted.
“The proposed rule is unlikely to affect small businesses awarded GSA FSS contracts as it implements a number of provisions and clauses currently in use in FSS solicitations and contracts,” the Federal Register notice stated.
But the coalition is questioning that assessment. “The Federal Register states that the proposed changes are not significant,” Roger Waldron, coalition president, wrote in a blog posting. “Many of these clauses, however, include very significant provisions that should be subject to greater explanation and disclosure by GSA before being incorporated into regulation—even if the proposed clauses have been previously used by GSA pursuant to internal guidance.”
The comment period ended on Nov. 21, with only three comments received at Regulations.gov. However, none were posted on the website as of this week.
The coalition has published its comment on its own website and also has asked the GSA to reissue and restructure the rule to facilitate more discussion.
