Final rule on past perf rating

      The SBA issued a final rule to create an additional path for small businesses to obtain past performance ratings for making offers on federal prime contracts.

      As authorized in the NDAA of fiscal 2021, the SBA is allowing a small business contractor to use a past performance rating for work performed as a member of a joint venture or as a first-tier subcontractor.

      Effective Aug. 22, prime contractors with subcontracting plans will be required to provide past performance to a first-tier small business subcontractor when requested by the small business. In such cases the prime contractor must provide the performance rating within 15 days.
