LPTA popular at DOD
While Congress has directed the Defense Dept. to be more selective in using Lowest Price Technically Acceptable (LPTA) criteria in contracts, the LPTA process remains popular at DOD, according to a new report by the Government Accountability Office.
The GAO estimated that in fiscal 2017 the DOD used the LPTA process in 26% of all competitively-awarded contracts over $5 million.
LPTA was used most often to buy fuel, information technology services and construction services.
Under Section 813 of the National Defense Authorization Act for Fiscal Year 2017, DOD was ordered to amend its regulations to require contracting officers to consider eight criteria when using the LPTA process. As of September 2018, the DOD had not done so, and contracting officers are not yet required to use the criteria, the GAO said.
Nevertheless, GAO reported that the DOD contracting officers generally considered five of the eight criteria.
GAO recommended that DOD amend its regulations, and the DOD said it would do so and would release additional guidance on LPTA by Dec. 31.
