Proposed rule expands Buy American

Hikes pricing evaluation factor for foreign-made

      A new proposed rule to implement President Trump’s Executive Order 13881 would expand the government’s preference for American-made products.

      The rule would raise the price preference for domestically-made end products to 30% for procurements from small firms, up from 12% currently. It also would hike the price preference to 20%, up from 6%, for such procurements from large businesses.

      The price preference is applied as a price evaluation factor in the bidding process. Under the new rule, the agency would add 30% to the price of the non-domestic end product offered by a small business. The new price would be used in evaluating the offer against other offers.

      Comments are due by Nov. 13.
