Buy American to be expanded
And EO rule feedback due
The Defense Dept. has proposed a new rule to begin enforcing certain Buy American domestic content purchasing requirements for contracts over $150,000. Currently, the threshold is $250,000, the same as the Simplified Acquisition Threshold.
The rule would implement a provision in the national defense bill of fiscal 2021 pertaining to domestic content restrictions for food, clothing, fabrics, fibers, flags and hand or measuring tools, along with commercially-available off-the-shelf items, with certain exceptions.
“The net effect of this revision will be to increase the number of acquisitions subject to the domestic source requirements at DFARS 225.7002,” the Federal Register notice states.
Comments are due by Nov. 29.
In a related action, DOD, GSA and NASA extended the deadline for comments on the recent proposed rule intended to maximize “Buy American” preferences in government procurement. The rule would implement President Joe Biden’s recent Executive Order.
The proposed rule was issued on July 30 and comments will be accepted until Oct. 28.
