Alutiiq wins court case
A recent U.S. Court of Federal Claims decision in favor of Alaska Native small business Alutiiq Manufacturing Contractors is being viewed as an indication that the government cannot lawfully terminate a contract based on “hostility” toward the contractors.
The judge ruled that “a number of disputes, poor practices, and conflicting personalities created a climate of dishonesty, distrust, and lack of effective communication.” Alutiiq got off to a poor start with the Defense National Guard Bureau contract, causing a 30-day delay, but the bureau overreacted with “hostility” and a default termination, eventually causing a year’s delay. The court said the termination for default should be converted to a termination for convenience.
