DOL expands overtime
The Labor Dept. announced a final rule to expand eligibility for overtime pay to an additional 1.3 million American workers. The rule goes into effect on Jan. 1, 2020.
Under the final rule, full-time employees who earn less than $684 a week, or $35,568 annually, must be paid at least one and a half times their hourly salary for each hour worked over 40 hours in a week. The limit previously was $23,660, or $455 weekly.
Executive, administrative and professional employees who earn more than $35,568 annually are exempt from minimum wage and overtime pay requirements. Employers are allowed to count a portion of certain bonuses and sales commissions as salary.
The rule also exempts from overtime “Highly-Compensated Employees” who earn over $107,432 a year, but don’t qualify for the regular exemption. The standard overtime rule affects 1.2 million workers and the highly-compensated employee provision affects about 102,000 workers.
