A stronger Buy American rule
The Biden Administration has proposed to strengthen “Buy American” policies within federal procurement, as spelled out in a proposed rule on July 30.
The proposed rule includes:
- Increases to the domestic content threshold to 60% initially, to 65% within two years and to 75% within five years,
up from 55% currently;
- A framework for applying an enhanced price preference for a domestic product considered to be a critical product or that is made up of critical components; and
- A requirement for contractors to report post-award domestic content.
Comments are due by Sept. 28. A virtual public meeting is on Aug. 26.
