House, Senate panels OK 2024 NDAAs

      The House and Senate armed services committees each recently approved their versions of the National Defense Authorization Act (NDAA) for Fiscal 2024. Both contain small business provisions.

      The House version authorizes $842 billion in discretionary funding for fiscal 2024, the same as President Joe Biden’s request. The Senate version would provide $844.3 billion. Both bills support Biden’s proposed 5.2% pay increase for military service members. Full texts are not yet available.

      The House Armed Services Committee’s NDAA summary includes these small business provisions:

  • Section 841 would create Entrepreneurial Innovation Project Designations to directly fund selected small business research and technology transfer projects;
  • Under Title VIII, Items of Special Interest, the committee asks for a DOD briefing on how to incorporate small innovative firms into larger-scale DOD acquisition frameworks;
  • Under Title VIII, Items of Special Interest, the committee directs DOD to report on the feasibility of providing contractors with performance assessments for their Other Transaction Authority contracts. This would primarily serve small businesses, new entrants and non-traditional contractors;
  • Under Title VIII, Items of Special Interest, the committee requests a report from DOD on the feasibility of sharing or developing more Sensitive Compartmentalized Information Facilities (SCIFs) for small business contractors;
  • Under Title VIII, Items of Special Interest, the committee directs DOD to submit a report on the concerns of Women-Owned Small Businesses.

      The Senate Armed Services Committee’s report states that the NDAA aims to “improve the timeliness of payments made to small business subcontractors.” There also is a reference to expanding DOD’s partnerships with innovative high-tech small firms.
