Fewer outs from Berry rule

      The Defense Dept. issued a final rule on April 28, effective immediately, that allows fewer exceptions to the Berry Amendment. The Berry amendment requires domestic production for national security for DOD purchases of food, clothing, fabrics, fibers, hand or measuring tools and flags, unless an exception applies.

      Previously, exceptions applied below the Simplified Acquisition Threshold, currently $250,000. Under the final rule, exceptions now apply only below $150,000.

      An estimated 72 small business vendors will be affected. They obtained 200 applicable awards above $150,000 but below the SAT in two years.
