HUBZ appeals at SBA’s OHA
Final rule in effect May 10
The Small Business Administration published a final rule giving the SBA’s Office of Hearings and Appeals jurisdiction over status protests of companies certified as HUBZone small businesses.
The final rule is effective May 10.
Previously, such appeals were heard by the SBA’s Associate Administrator for Government Contracting and Business Development. However, SBA did not publish those appeal decisions, making them of little use to others. Under the new procedure, the decisions will be public.
“This is a big step for SBA and will certainly bring consistency and insights to the protest process and regulatory interpretation for HUBZone participants,” Stephanie Ellis, attorney with Koprince Law LLC, wrote in a recent blog.
The final rule implements a provision in the National Defense Authorization Act for Fiscal Year 2022.
