US Supreme Court declines to hear 8(a) challenge
The U.S. Supreme Court decided not to hear a longstanding case challenging the constitutional basis of the SBA’s 8(a) program.
The court let stand a previous decision by a lower court that denied the claims in the petition filed by Rothe Development Inc.
Supporters of 8(a) are calling it a big victory. Rothe had argued in its petition that the 8(a) program had established racial classifications, which are unconstitutional. An appeals court ruled against Rothe’s petition; the Supreme Court left that decision alone.
GAO against NDAA item
US Comptroller General Gene Dodaro reportedly is against the Senate NDAA provision that would force contractors who file failed bid protests to reimburse the cost of the protests.
Dodaro heads the GAO, which hears bid protests. He opposes the provision because it would create additional costs and possible legal issues for the GAO. Read more here:

CMS now using OASIS
The Centers for Medicare and Medicaid Services is the latest agency to agree to use the GSA’s “OASIS” professional services multiple-award contract, according to a report by FedScoop.
The Medicaid and Medicare agency signed a memorandum of understanding with the GSA.
