CMS clause too restrictive for small biz?

A recently-amended clause in a Centers for Medicare & Medicaid Services solicitation is raising concerns for small business. The clause is in the amended Statement of Work issued Aug. 13.

It states: “All CMS IT contractors providing development and/or maintenance support, system integration, and/or engineering and technical support solutions for CMS shall be at Level 4 CMMI®.”

“It is too restrictive for small businesses. Few are at Level 4,” a source told Set-Aside Alert. It was not clear whether CMS intends to enforce the clause as a new policy directive for all CMS IT contractors.

The draft Statement of Work initially stated that contractors providing solutions for “CMS payment systems” must be at Level 4. But CMS later broadened its application to all of CMS.

CMS officials were not immediately available to comment.
