Senate OKs NDAA 2020;
House, Sen. bills make DOD mentoring permanent
The National Defense Authorization Act for fiscal 2020 is moving forward in both chambers of Congress. The Senate passed its version on June 27, and the House Armed Services Committee released a draft of its bill on June 11.
Both versions permanently reauthorize the Defense Dept.’s longstanding mentor-protege program.
As part of that, the House bill enlarges the definition of “Small Business Concern” in the DOD mentor-protege program. Instead of requiring that the firm be half the size corresponding to its NAICs code, it allows firms to be the size corresponding to their NAICS codes. It also sets performance goals and orders regular reviews.
Other provisions in the House bill include:
- Sec. 828 is on enhanced debriefings: Currently, for contracts over $100 million, the DOD must provide a redacted version of its source selection award determination to other bidders during their debriefings. In the House bill, the threshold for that requirement would be reduced to $50 million;
- Sec. 831 allows subcontractors to file complaints regarding non-payment with agency Offices of Small and Disadvantaged Business Utilization (OSDBUs);
- Sec. 872, implementing the Runway Extension Act, orders the SBA to issue a rule by Dec. 31, 2019 and to set up a transition plan to the new size standard;
- and Sec 878 aligns the Small Business Innovation Research and Small Business Technology Transfer programs with DOD strategy.
