Reopenings bring issues, lawyers say

      Contractors and other firms that resume operations during the coronavirus pandemic are likely to be facing some legal challenges.

      While many firms went to telework or closed down in March, some governors are lifting restrictions. Businesses have to balance the goals of getting back to work while also protecting workers from infection and from discrimination.

      Some business owners and Republicans want Congress to approve a broad exemption from liability for businesses that reopen and fear being blamed for subsequent COVID-19 deaths or injuries among their workers. Sen. Mitch McConnell, R-KY, recently said that approving such protection for businesses is a priority, but Democrats say worker safety and public safety are foremost.

      Law360 recently outlined some of the issues to consider while preparing to reopen, including following all guidance from the CDC, OSDHA and state and local health authorities.
