New process to add tribes

The Bureau of Indian Affairs (BIA) recently issued a proposed rule to set up a process to allow non-federally-recognized Alaska Native entities to become federally-recognized as tribes.

Congress in 1936 allowed groups of Indians to organize under the Indian Reorganization Act and petition for federal recognition as tribes on a case-by-case basis. The new rule would create a standard procedure for petitions.

"This proposed rule opens the door for the creation of more Alaska Native Corporations (ANCs) and tribal businesses," PilieroMazza PLLC said in a client alert.
