Small firms filing most DOD protests
Small business federal contractors accounted for the majority of bid protests against the Defense Dept. from fiscal 2008 to fiscal 2016, according to a new report by the RAND Corp. nonprofit research group.
Out of more than 11,000 protests against DOD filed at the Government Accountability Office during the period, small firms filed 53%. Small companies also filed 58% of the 475 such protests at the Court of Federal Claims.
The study also said that small-business protests were 1.5 times as likely to have their protests dismissed for being “legally insufficient,” the study said.
“These trends suggest that more protests filed by small businesses might be successful with better legal representation,” the report said.
