SBA releases list of upcoming new regulations
The SBA released its Semiannual Regulatory Agenda indicating new regulations being developed in the next six months. The list is comprised of four new proposed rules, 7 final rules and one long-term project.
Nine of the 12 new regulations involve size standards, mostly due to the statutory requirement to update size standards every five years.
Also, a new proposed rule is on the way for allowing agencies to receive small business credit for lower-tier subcontracting. The notice of the proposed rulemaking is anticipated in May.

OHA decision affects recertifications
The SBA’s Office of Hearings and Appeals (OHA) made several significant decisions regarding SBA’s recertification rules, according to an analysis by PilieroMazza PLLC.
OHA confirmed that SBA’s recertification rules apply to single-award contracts and Multiple-Award Contracts (MACs). Previously, SBA had applied those rules only to MACs.
OHA also ruled on the timing of applying versions of SBA’s recertification rules and on other related issues.

GSA’s Robomod IDs unauthorized suppliers
GSA said it has begun implementing a new “Robomod” process on a pilot basis to identify unauthorized Multiple-Award Schedule (MAS) suppliers and remove unauthorized products on GSA Advantage.
Unauthorized MAS contractors will be identified based on information from the Verified Products Portal (VPP).
GSA will notify impacted MAS contractors if VPP data indicates a discrepancy. GSA will provide a list of the alleged unauthorized products at that time.
Contractors will have 30 days to appeal. If there is no appeal the product will be removed from GSA Advantage.
