COFC backs late-is-late
While the Court of Federal Claims at times has been more lenient than the GAO on late-delivered offers to the government, the court recently upheld a strict late-is-late finding by the IRS.
In the case, FreeAlliance at 11:51 am emailed supplemental documents for its bid on an IRS contract. Bids were due at 12 pm. The company obtained verification that the documents arrived at the IRS at 12:06 pm, delayed by a technical glitch.
The IRS rejected the bid for being late. FreeAlliance then filed a protest with the court. The court agreed with IRS.
“This case reinforces the importance of submitting proposals with ample time,” wrote Caitlin Crujido, associate with Morrison Foerster.
