DOL to rescind Trump’s indie contractor rule
The Labor Dept. has proposed to rescind a controversial independent contractor rule dating from the former Trump Admin. and to implement a new rule regarding independent contractors. Comments are due by Nov. 28
DOL says the proposed new framework is “more consistent with longstanding judicial precedent” and protects worker rights.
Under the FLSA, employees are entitled to minimum wage, overtime pay and other benefits, while independent contractors are not. The Trump-era rule was viewed as favoring companies that use gig workers, including Uber and Lyft.
The Trump Admin.’s independent contractor rule was supposed to go into effect in March 2021, two months after President Biden took office. The Biden Admin. delayed the rule, but it was reinstated by a Texas judge in March 2022 due to a finding that not enough time was offered for public comment on the delay. The rule currently is in effect.

DOD adds to China tech blacklist
On Oct. 5, DOD released an updated Blacklist of prohibited Chinese military tech companies. The Blacklist was authorized under Section 889 of the NDAA of 2019, which banned the use of covered Chinese tech that threatens US national security.
