Unpriced Schedules
New proposed rule
Federal agencies took a step toward implementing unpriced schedules contracts for services.
The Federal Acquisition Regulation Council recently published a proposed rule that would allow the Defense Dept., Coast Guard and National Aeronautics and Space Admin. to award multiple-award task order contracts for services without considering price or cost as an evaluation factor. But agencies would have to consider price or cost when awarding task orders. Comments are due by Nov. 23.
In addition, Sect. 876 of the John S. McCain National Defense Authorization Act for Fiscal 2019 gave agency heads the discretionary authority to not include price or cost as an evaluation criterion when awarding services contracts that are acquired at an hourly rate.
The law created the so-called “unpriced” schedules contract, according to the Coalition for Government Procurement. The coalition supports unpriced schedules to reduce red tape, reduce costs, increase competition, provide flexibility and reduce barriers to entering the market.
