Contractor Information to be Open to Public

The public will soon be able to see the government’s “bad boy” list—the Federal Awardee Performance and Integrity Information System, or FAPIIS.

The database contains information about many kinds of adverse actions against contractors, from civil and criminal judgments to suspensions and debarments. It is currently open only to contracting officers and a small number of federal officials.

But a little-noticed provision of the wartime supplemental appropriations bill, signed into law by President Obama on July 29, would open most of the database to the public.

When Congress created FAPIIS last year, the sponsors originally intended for the information to be public, but agreed to restrict access after objections from industry. Contractor groups said the database was intended to help agencies find responsible contractors, and public access could only embarrass companies without any benefit to the government.

Under the new law, sponsored by Independent Sen. Bernie Sanders of Vermont, contractors’ past performance records would not be made public. But anyone would be able to see all other FAPIIS information.
