SBA Sets Timetable for Size Standards Review SBA plans to propose new size standards in six NAICS sectors and issue a final rule on standards for professional, scientific and technical services before the end of the year. The timetable for the proposed rules is set out in the agency’s semiannual regulatory agenda: •September: Sector 22, Utilities Industries. •October: Sector 51, Information Industries; Sector 56, Administrative and Support, Waste Management and Remediation Services Industries; Sector 62, Health Care and Social Assistance Services Industries. •November: Sector 53, Real Estate, Rental and Leasing Industries; Sector 61, Educational Services Industries. The agenda says the final rule for NAICS sector 54, covering professional, scientific and technical services, will be issued in November. The timetable is subject to change. SBA plans to issue proposed rules to establish mentor-protégé programs for the service-disabled veteran-owned, HUBZone, and woman-owned contracting programs in August. The agency has said the rules will be similar to those for the 8(a) mentor-protégé program. Other items on the agency’s ambitious regulatory agenda for the rest of 2011 include: *Proposed rules to guide agencies in setting aside part of a multiple award contract for small businesses, setting aside orders placed against multiple award contracts for small businesses, and reserving one or more awards for small businesses under full and open competition for a multiple award contract. These rules would implement acts of Congress. *Proposed rules to address intentional misrepresentations of small business status as a “presumption of loss against the government,” as required by the Small Business Jobs Act of 2010. This rule would make it easier for the government to seek financial penalties for companies that falsely claim to be small. *Proposed rules to set new governmentwide policy on contract bundling, address teams and joint ventures and the limitations on carrying out consolidated contracts. *Proposed rules to address bait-and-switch subcontracting. A new law requires a large prime contractor to represent that it will make a good-faith effort to comply with its small business subcontracting plan.
