SAVE THE STORY AS STORY1.HTM THRU STORY99.HTM. --> <P> <!--<h2> <i>Set-Aside Alert</i> news analysis: </h2> --> <h1> Small business provisions in NDAA </h1> <h4> Reauthorizing SCORE; changes to SBDCs, Women s Business Centers </h4> <p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Following a pattern of recent years, the House Armed Services Committee approved several small business provisions in the fiscal 2018 National Defense Authorization Act (NDAA). </p> <p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; The measures would reauthorize the Small Business Administration s  SCORE program and make changes to its Small Business Development Centers and Women s Business Centers, according to the bill text released by the committee chairman. There also would be some modifications in definitions and terms used in small business contracts. </p> <p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; There is concern about the impact of Sect. 801 regarding the government buying from online marketplaces <a href="story6.htm">(go to separate story in this issue)</a>. </p> <p> <b>SCORE program</b> </p> <p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; The SBA s Service Corps of Retired Executives (SCORE) program would be reauthorized and permanently referred to as SCORE under the bill. The SCORE program offers counseling to small business owners by volunteer retirees. </p> <p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; The NDAA also would require an annual report on the effectiveness of the program, and would direct the SBA to establish standards protecting the information of entrepreneurs counseled by SCORE. </p> <p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; In addition, SBA would be required to use webinars and electronic mentoring to increase SCORE s impact. The SBA also would need to report to Congress on the online outreach and to do a five-year strategic plan report. </p> <p> <b>Women s Business Centers</b> </p> <p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; The House version of the NDAA would require the SBA s Office of Women s Business Ownership to set up an accreditation program for its grant recipients. </p> <p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Furthermore, the bill would define key terms relating to eligibility for grants and adjust the statutory cap on grants and the requirement for matching funds by $35,000. It also would establish a mechanism for use of unobligated grant funds at the end of the fiscal year and improve oversight of grant recipients. </p> <p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; The SBA also would be ordered to do longer-term planning for the WBCs that includes continued authorization levels, and to improve the application process. </p> <p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; The NDAA also would limit the ability of the SBA Administrator to waive the requirement for matching funds by grant recipients, according to the bill text. </p> <p> <b>SBDCs</b> </p> <p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; The NDAA would prohibit the SBA Administrator from using programs unauthorized by Congress to deliver entrepreneurial development assistance. It would further require the SBA Administrator to report on all such activities to Congress. </p> <p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Those provisions address a pet peeve of the House Small Business Committee. Lawmakers from both parties have criticized the SBA in the past for setting up new programs to deliver training and assistance without explicit permission from Congress. </p> <p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; The NDAA also would allow Small Business Development Centers (SBDCs) to have more flexibility in marketing and advertising their products and services. </p> <p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Other provisions affecting SBDCs include: <ul> <li> The SBA would meet with the Association of SBDCs to develop data collection documents. As a result there would be a data collection and a report to Congress. <li> SBDCs would be allowed to collect fees for operating partnerships and cosponsorships. Such fees currently are not permitted. <li> The SBA could pay up to $100,000 more to the Association of SBDCs for accreditation services. <li> The SBA would be prohibited from sharing SBDC client information with third parties.  Sharing sensitive information, such as the name of a business, is not necessary, the bill text stated. <li> The bill would allow only higher education institutions to become SBDCs. Current participants would be allowed to remain an SBDC even if they do not meet that requirement. </ul> </p> <p> <b>Section 8(d)</b> </p> <p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; The NDAA has language regarding the past performance pilot program authorized in section 8(d) of the Small Business Act. It allows small firms to use defense weapons sales to U.S. allies as past performance. </p> <p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Most of the NDAA provisions were developed by members of the House Small Business Committee. </p> <p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; HR 1773, submitted by Chabot, and HR 1774, submitted by Rep. Nydia Velazquez, D-NY, ranking member of the committee, were included in the NDAA.
