Federal contractors should be prepared for the possibility of new regulations requiring that their employees be vaccinated against COVID-19, legal specialists are saying.
“Do not be surprised if, before the end of 2021, the federal government begins requiring contractors to certify or represent that their employees have received COVID vaccinations,” attorneys from the Blank Rome law firm wrote in a recent blog.
The Biden Administration is distributing vaccines at a brisk pace and has committed to having enough vaccines for all adults by the end of May.
With federal contractors historically being in the forefront of White House labor initiatives in recent decades, there is a good chance the Biden administration will pursue some type of vaccine certification rule for contractors--whether through executive order or FAR regulation, the attorneys wrote.
It also appears to be legally permissible to require employees to be vaccinated as a condition of employment, subject to exceptions, the attorneys said.
