Biden signs EOs

Diversity EO rescinded;
Contractor mask mandate

      Within days of his inauguration, President Joe Biden had signed several dozen Executive Orders, including many that reversed policies by his predecessor. Among those that impact small federal contractors are:

  • EO on Advancing Racial Equity and Support for Underserved Communities Throughout the Federal Government: This order revokes the controversial Trump Administration EO 13950 banning race and sex “stereotyping” and “scapegoating,” among other actions. The Trump order already was on legally shaky ground, having been found likely unconstitutional by a federal court. The canceled EO had banned vague “divisive concepts” in federal diversity trainings, even for contractors’ own employees. Harsh penalties were to be imposed on contractors who failed to comply. The Biden order also sets up a goal of pursuing goals of equity and inclusion in government opportunities, including in processes to measure equity and data collection.
  • EO on Protecting the Federal Workforce and Requiring Mask Wearing: The order says on-duty and on-site federal workers and contractors must wear masks while in federal buildings and on federal lands. They also must maintain physical distance and adhere to other health measures under Center for Disease Control guidelines.
  • EO on Protecting the Federal Workforce: President Biden rescinded the Trump Administration’s controversial order to create a new “Schedule F” within the federal civil service that would remove job protections and allow employees to be fired without cause. Critics said it would politicize hundreds of thousands of federal jobs. Biden said the order was unnecessary and contrary to civil service law.
  • EO on Revocation of Certain Executive Orders Concerning Federal Regulation: President Biden revoked six EOs from former President Trump pertaining to the previous administration’s drive to reduce regulation. Canceled orders include controversial EO 13771, which set a goal of eliminating two regulations for each new regulation.
